LICENSE AGREEMENT

Ownership of the Software

The enclosed software program ("Software") and the accompanying documentation are owned by RPT Software LLC or its suppliers and are protected by United States copyright laws, by laws of other nations, and by international treaties. You must treat the Software like any other copyrighted material except that you may make one copy of the Software solely for backup or archival purpose, and you may transfer the Software to a permanent storage device.

Redistribution Rights

The Software may not be redistributed, in whole or part, in any form without express written permission from RPT Software LLC. Restrictions

Under no circumstances may you attempt to reverse engineer this product. You may not rent or lease the Software, but you may transfer the Software and the accompanying written materials on a permanent basis provided you retain no copies and the recipient agrees to the terms in this Software License. Ownership transfers must be reported to RPT Software LLC in writing.

Limited Warranty

ALL IMPLIED WARRANTIES ON THE SOFTWARE AND/OR DOCUMENTATION, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO SIXTY (60) DAYS FROM THE DATE OF PURCHASE OF THIS PRODUCT. Although RPT Software LLC has tested this program and reviewed the documentation, RPT Software LLC makes no warranty or representation, either expressed or implied, with respect to this software, its quality, performance, merchantability, or fitness for a particular purpose. As a result, this software is licensed "AS-IS", and you are assuming the entire risk as to its quality and performance.

Limitation of Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL RPT Software LLC OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, OR FOR ANY DAMAGES IN EXCESS OF RPT Software LLC'S LIST PRICE FOR A LICENSE TO THE SOFTWARE AND DOCUMENTATION, EVEN IF RPT Software LLC SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.
